How much money can a landlord legally request as a security deposit when renting in Spain in 2026? This issue, which generates frequent disputes between owners and tenants, is strictly regulated by Article 36 of the Urban Leases Act (LAU - Ley de Arrendamientos Urbanos). Under this law, for residential primary residence rentals, the landlord can only request 1 month of mandatory security deposit (fianza) in cash. Additionally, the parties can agree on extra financial guarantees (additional cash deposits or bank guarantees) to cover potential unpaid rents or damages, but this additional amount is capped at 2 months of rent. This means the total upfront deposit and guarantee package cannot exceed 3 months of rent in total. If the lease is for non-residential purposes, such as commercial premises or offices, the mandatory deposit is 2 months and there is no legal limit for additional guarantees. 🔍 How Rental Deposits are Regulated in Spain

The Urban Leases Act (LAU) makes a clear distinction based on the property’s intended use:

  1. Primary Residence Rentals (Vivienda Habitual):
    • Mandatory Legal Deposit (Fianza): 1 month of rent. The landlord is legally required to deposit this cash with the official regional registry (such as IVIMA in Madrid or INCASÒL in Catalonia) for the duration of the lease.
    • Maximum Additional Guarantee: 2 months of rent. This is the legal cap introduced by Royal Decree-Law 7/2019 to prevent landlords from asking for abusive deposits.
    • Maximum Total Allowed: 3 months of rent. Any contract clause requiring 4 or 5 months of deposit for a primary residence is legally null and void.
  2. Non-Residential Leases (Commercial, Offices, Seasonal Rentals):
    • Mandatory Legal Deposit (Fianza): 2 months of rent.
    • Additional Guarantee: Unlimited. The parties can freely agree on bank guarantees or deposits of 6 months or 1 year depending on the commercial risk.

⚠️ 4 Common Mistakes to Avoid

  1. Paying the deposit in cash without a signed receipt: Not having a signed payment receipt with the landlord’s ID makes it very difficult to claim your deposit back when the lease ends.
  2. Using the deposit to pay the last month of rent: The tenant cannot withhold the last month’s rent under the pretense of “using the deposit”. The deposit is meant to cover property damage and unpaid utility bills, not rent.
  3. Not checking if the landlord registered the deposit: In Spain, the landlord must deposit your security deposit with the regional government. If they fail to do so, you will not be able to claim regional rental tax deductions on your income tax return. Ask for the deposit registration receipt.
  4. Signing unlimited bank guarantees for residential leases: Bank guarantees also count towards the additional guarantee limit, meaning they are subject to the 2-month cap when combined with cash deposits.

📌 Special Cases

1. Seasonal rentals (e.g., student rentals for 9 months)

Even if the property is residential, seasonal rentals (for studies or short-term work placements) are classified under “use other than residential”. Therefore, the mandatory deposit is 2 months and the 2-month cap on additional guarantees does not apply.

2. Long-term leases (Exceeding 5 or 7 years)

In long-term leases signed with corporate landlords, the parties are legally allowed to agree on additional guarantees exceeding the 2-month cap, provided it is explicitly negotiated in exchange for specific lease terms.

  • If you are a residential tenant: Know your rights. Your total upfront deposits and financial guarantees cannot exceed 3 months of rent. Any demand above this threshold is legally void.
  • If you are a landlord: Always deposit the mandatory security deposit with the regional authority registry. Failing to do so can result in fines ranging from 50% to 150% of the deposit amount.
