The Spanish Dependency Act (officially Ley 39/2006 de Promoción de la Autonomía Personal y Atención a las personas en situación de dependencia) guarantees public aid and support services to individuals who cannot perform basic activities of daily living independently due to age, illness, or disability. This law establishes the System for Autonomy and Care in Dependency (SAAD), coordinated nationally by IMSERSO and managed directly by the social services departments of each autonomous community.

One of the most frequently requested aids is the Financial Benefit for Care in the Family Circle (PECEF). This monthly cash grant is paid to help cover expenses when a dependent person is cared for at home by a family member. The monthly grant is not a flat rate: it is calculated based on the recognized dependency grade determined by a social worker (Grade I, II, or III) and the financial means or income of the dependent person. In Spain, maximum aid rates were updated by Royal Decree 675/2023, which also established mandatory minimum protection rates that the state must pay regardless of how high the dependent’s income is.

This online calculator helps you estimate the net monthly benefit you will receive for home care, after applying the statutory copayment rules based on the IPREM index.

⚙️ Dependency Grades & Maximum Benefits

The SAAD classifies dependency into three levels with the following statutory maximum and minimum rates for 2026:

  • Grade I (Moderate Dependency): The applicant needs help at least once a day for basic tasks. Maximum benefit: €180.00 per month. Guaranteed minimum: €60.00 per month.
  • Grade II (Severe Dependency): The applicant needs help two or three times a day but does not require a full-time caregiver. Maximum benefit: €315.90 per month. Guaranteed minimum: €120.00 per month.
  • Grade III (High Dependency): Complete loss of physical or mental autonomy. Continuous, lifelong support is needed. Maximum benefit: €455.40 per month. Guaranteed minimum: €180.00 per month.

📐 The Spanish dependency copay formula

The copayment rules progressively reduce the maximum benefit if the dependent’s net income exceeds the monthly IPREM index (€600.00). The calculation operates as follows:

  1. If net income is less than or equal to 1.0x IPREM (€600.00): The beneficiary receives the 100% maximum benefit for their grade.
  2. If net income is between 1.0x and 2.5x IPREM (between €600.00 and €1,500.00): The benefit is reduced proportionally: Benefit = Maximum Benefit - [(Income - IPREM) / (1.5 × IPREM)] × (Maximum Benefit - Minimum Benefit)
  3. If net income is greater than 2.5x IPREM (above €1,500.00): The beneficiary receives only the Guaranteed Minimum Benefit for their grade.

📊 Worked dependency aid calculations

We review two typical scenarios under Spanish regulations:

Example 1: High dependency (Grade III) applicant with a minimum pension

Grade III recognized, monthly net income of €600.00 (1.0x IPREM)
  • Maximum Grade III benefit: **€455.40**
  • Income adjustment: Since income is equal to 1.0x IPREM, no reduction applies.
Final monthly benefit: **€455.40**

Example 2: Severe dependency (Grade II) applicant with a medium-high pension

Grade II recognized, monthly net income of €1,050.00 (1.75x IPREM)
  • Maximum Grade II benefit: **€315.90** | Guaranteed minimum: **€120.00**
  • Proportional reduction calculation:
    • Income difference: **(€1,050 - €600) = €450**
    • Reduction ratio: **€450 ÷ (€1.5 × €600) = 450 ÷ 900 = 0.50 (50%)**
    • Benefit reduction: **0.50 × (€315.90 - €120.00) = €97.95**
  • Final benefit calculation: **€315.90 - €97.95 = €217.95**
Final monthly benefit: **€217.95** (which is above the statutory minimum of €120.00)

⚠️ Common mistakes when applying for dependency aid

  1. Including the income of the entire household: The financial assessment for dependency benefits only counts the personal income of the dependent person (their pension or investment dividends), not the salaries of children or spouses they live with.
  2. Assuming any relative can be the designated caregiver: To qualify for the PECEF family care grant, the caregiver must be a spouse or relative within three degrees of consanguinity, live in the same house, and have been caring for the applicant for at least one year.
  3. Not applying because of high income: Even if the dependent person has a large pension or significant assets, they are still legally entitled to the guaranteed minimum benefit (up to €180.00/month for Grade III) and access to public support services.

❓ Frequently Asked Questions (FAQ)

The maximum statutory response time is 6 months from application. However, in practice, administrative backlogs mean the entire process (medical evaluation, grade resolution, and PIA approval) typically takes 10 to 18 months depending on the region.

Yes. Backpayments are legally recognized. Retroactive payments begin accumulating 6 months after your application date if the regional social services have not resolved the case within the statutory timeframe.

Yes. Under the Special Agreement for Non-Professional Caregivers, the Spanish government directly pays the caregiver's social security and retirement contributions. This does not reduce the dependent's benefit amount.

No. The family care benefit (PECEF) is incompatible with a place in a public or subsidized nursing home. If the dependent person moves into a public care home, the monthly cash grant is automatically terminated.

The Individual Care Plan (PIA) is the final stage of your application. Written by a municipal social worker, it details the specific mix of support (cash grants, home help, day center slots, or nursing home options) best suited for the applicant.

Yes. You can request a grade review (solicitud de revisión de grado) at any time due to worsening health. You must submit updated medical reports proving the decline in physical or cognitive capacity.
